CONSIDER AND ACT: on a Request by Brenk and Amanda Johnson for an Amendment to the Zoning Ordinance to Allow Treehouses in Front Yard

BACKGROUND:
The City received a complaint in July regarding a newly constructed treehouse at 3620 Wentwood. Code Enforcement staff investigated the complaint and determined that the treehouse violated Section 21-100 (4) (b) of the University Park Zoning Ordinance. The property owners were notified of the violation on July 20; however a citation has not been issued for the violation.
Brenk and Amanda Johnson have submitted a request to the City for an amendment to the zoning ordinance which would allow treehouse house construction in the front yard. The zoning ordinance must be amended to allow for treehouse construction in the front yard if the City wants to allow Mr. & Mrs. Johnson to keep the treehouse in its current location. Section 21-100 (4) (b) states:
Except as provided in the following paragraphs, no accessory structure, portable storage container, object,or appurtenance shall be permitted to be placed or maintained in a required front yard in a residential district in the City.
The City Council tabled this item during its October 6 City Council meeting. Staff has looked at comparable cities throughout Texas regarding their zoning regulations for treehouses (see attached summary). Staff requests Council direction regarding this item.
